Booking Conditions
These conditions are listed below.
In these conditions the “Company” shall mean Stone Tours & Adventures (Private Limited) and, where applicable, shall include its Servants, Employees, Directors and Agents. The “Passenger” shall mean the person in whose name the booking is made and accepted and shall include, so that they are bound by these Conditions, every person on whose behalf the booking is made and accepted. “Holiday” shall mean tour, holiday or other travel arrangements.
Payments
Any monies paid by the passenger to the travel agent are held by the travel agent on behalf of the passenger until such time as the passenger receives confirmation invoice from the company accepting the booking. Thereafter a travel agent holds the passenger’s monies as an agent of the Company until such time as payment is required by the Company.
Cancellations
All cancellations made by the passengers must be notified in writing to the Company and for cancellation prior to 48 Days before departure the Company shall be entitled to retain any deposit and insurance premium paid. Any charges levied by the suppliers of accommodation or other services, in consequence of any cancellation, will be passed on to the passenger and must be paid by him. Any cancellation made by the passenger within 48 days of departure will be subject to the following charges:
48 to 29 days - 20% of total holiday cost
28 to 15 days -25% of total holiday cost
14 to 6 days -35% of total holiday cost
5 to 2 days -50% of total holiday cost
On tour commencement day OR thereafter 100% of Total
Any holiday for which full payment of the original account has not been made by 56 days before departure may at the Company’s option be deemed to be cancelled by the passenger and the passenger notified accordingly and the above charge maybe imposed in respect of it.
The Company may on its own discretion cancel a holiday and shall give notice to the passenger or travel agent through whom he has booked. In such a case the Company shall offer to the passenger a comparable holiday (if available) which is no way substantially different from that originally booked – applying towards the costs all sums paid by him in respect of the cancelled holiday, or, if this is not acceptable to the passenger, a refund of all sums paid for the cancelled holiday.
Where in clause 4 of these conditions the passenger has been made an offer or given an option and the Company within a period of 21 days has not received notice from the passenger of his acceptance of the offer or exercise, the passenger shall be deemed to have elected to receive a refund of all monies paid by him in respect of the holiday cancelled or altered as the case may be.
If cancellation by the Company results from force matters (e.g. storm, flood, fire, earthquake, war, hostilities or insurrection, industrial action or any act of Government or Governing Authority) the Company shall be entitled to deduct from any refund such reasonable costs as they may incur or have incurred in connection with the cancelled facilities.
Disclaimer
The Company does not own aircrafts, accommodation or restaurants used in connection with these tours, but has contracted with the owners/Managers. The conditions under which they operate form part of the conditions governing these tours and passengers are deemed to accept these. The Company will exercise due diligence and responsible care in entering into such contract on behalf of the passengers, but cannot accept liability for any loss, resulting from delays in transportation or from injuries, strikes, civil disturbance, quarantine, floods or similar hazards, distress or disappointment. The Company will use its best endeavors to provide substitute facilities of an equal or similar standard to those specified. While considerable care has been in compiling this information it is not intended that any item of the information should in anyway inaccurate or misleading. All information is solely for the guidance of clients tours with the company.
The Company reserves the right to alter advertised itineraries and routes without notice and without making increase or reduction in price charged, to substitute other hotels or lodges for those advertised and to deviate from advertised routes if in the opinion of the Company it is necessary or advisable so to do.
Arrangements for travel and accommodation in foreign countries are subject to the laws of such countries except any questions affecting the liability of the Company during the tour shall be determined in accordance with English law.
The Company reserves the right to require any person to withdraw from a tour where it is deemed their behavior or conduct is likely to interfere with the general well-being of the tour and other passengers. This will also apply for purposes of law and other regulations or requirements of any country through which that person(s) is traveling during the tour.
